These terms are an agreement between you and Agori Labs Inc. ("we," "us"), which operates Brightwend. By using Brightwend you agree to them. Please also read our Privacy policy.
1. Who can use Brightwend
You must be 18 or older. You're responsible for keeping your phone and sign-in codes to yourself. If you set up Brightwend for someone else, you must have their permission, and the account belongs to them.
2. What Brightwend is, and isn't
Brightwend suggests activities. It is not a medical, care, emergency, transport or safety service, and it doesn't replace advice from your doctor. Every activity is optional. You decide whether an activity suits your health, abilities, the weather and the day, and you take part at your own risk.
3. Place information
Details about places, including access, hours, parking and facilities, come from what those places or their operators publish. We name the source, but we don't inspect places and can't guarantee the details are accurate, complete or current. It's your responsibility to confirm anything that matters to you before you go. We don't own or control the places we suggest and aren't responsible for them. See Place information.
4. The Family plan
- The Family plan costs $139 a year, plus any applicable tax, and is paid by the family member who sets it up.
- From time to time we may offer a promotional price, such as a holiday price for the first year. The price shown at checkout is the price you pay. After a promotional first year, the plan renews at the regular price, and we'll remind you before it does.
- New Family plans start with a 14-day free trial. Unless you cancel before the trial ends, you'll be charged for a year.
- The plan renews every year. We'll remind you before each renewal.
- You can cancel any time in the app. Your plan stays active until the end of the year you've paid for.
- If you cancel within 14 days of a renewal charge, email us and we'll refund it in full.
- If we ever change the price, we'll tell you at least 30 days before it applies to you.
Gifts
A Brightwend gift is a one-time payment of $139, or the promotional price shown at checkout, for one year of the Family plan for one person, starting when the code is redeemed. Gifts don't renew automatically. Gift codes don't expire and can't be exchanged for cash. If a code hasn't been redeemed, the buyer can get a full refund within 30 days of purchase.
5. Your content
Notes, photos and voice notes you add stay yours. You give us permission to store them, show them to the people you choose to share with, and print them in a year book if you or your family order one. We use them only to provide Brightwend to you. Delete them and that permission ends, except for copies already printed.
6. How to behave
Be kind. Don't use Brightwend to harass, deceive, ask for money, sell things, or contact people who haven't agreed to hear from you. Don't pretend to be someone else, and don't try to break or copy the app. We may remove content or close accounts that break these rules, especially where someone's safety is at risk.
7. Meeting other people
If you turn on connections with other members, use your own judgment. Meet in public places, tell someone where you're going, and never send money to anyone you met through the app. We work to keep the community safe, but we can't vouch for every member. See Safety.
8. Changes and ending
We'll keep improving Brightwend, which means features may change. If we change these terms in a way that matters, we'll tell you in the app first. You can stop using Brightwend and delete your account at any time.
9. Disclaimers and limits
Brightwend is provided "as is." As far as the law allows, we don't make promises about it beyond those in these terms. We are also not responsible for indirect or consequential losses, or for injury or loss arising from activities, places or other people. If we're found responsible for something, our total liability is limited to the greater of what you paid us in the 12 months before the claim or $100. Some places don't allow some of these limits, so they may not all apply to you.
10. Law and disputes
These terms are governed by the laws of the State of Delaware. If there's a problem, please email us first, since most things get sorted out that way. Any disputes will be heard in the state or federal courts located in Delaware.
